Petitioner, who is in custody, seeks bail in connection with Obra P.S. Case No. 82 of 2011 registered for the offences punishable under Section 409 of the Indian Penal Code.
Allegation against petitioner is of embezzlement and misappropriation of government money.
It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. Petitioner has no criminal antecedent. Similarly placed coaccused have been granted anticipatory bail by co-ordinate Bench of this Court in Cr. Misc. No. 25889 of 2018 and Cr.
Patna High Court Cr.Misc. No.63920 of 2018(2) dt.29-10-2018 2/2 Misc. No. 15562 of 2018 vide order dated 04.05.2018 and 05.04.2018 respectively. Petitioner is in custody since 29.08.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad (Bihar), in connection with Obra P.S.
