JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2018 Petitioner prays for bail in connection with Kotwali (Tilkamanjhi) P.S.Case No. 649 of 2016 registered for the offence punishable under Section 407 of the Indian Penal Code. Allegation as per FIR is that informant has booked some goods with the Transport Company of the petitioner and the same has not been delivered and as such petitioner has cheated the informant of Rs.405024/-.

Submission of learned counsel for the petitioner is that shop of the petitioner has already been closed four months prior to the occurrence and challan has also been annexed with the FIR and moreover he is in custody since 26.7.2018. Heard learned APP and learned counsel for the informant, who has opposed the prayer for bail of the petitioner.

No.65852 of 2018(2) dt.26-11-2018 2/2 Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Kotwali (Tilkamanjhi) P.S.Case No. 649 of 2016, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
