The petitioners apprehend their arrest in connection with Hulasganj P.S. Case No. 88 of 2019, registered under Sections 147, 149, 341, 323, 307, 504 and 506 of the Indian Penal Code, pending in the court of the learned SubDivisional Judicial Magistrate, Jehanabad. The accusation is that on 01.07.2019, in the

Patna High Court CR. MISC. No.79622 of 2019(3) dt.08-01-2020 2/2 evening, while informant Appu Sharma was present at his cement shop situated in the Hulasganj market. In front of his shop, tractor of Nandu Sharma (Petitioner No.1) was parked on which driver was sitting. The informant asked to diver to remove the tractor, then petitioner No.1 told him that the tractor will be removed after some times. When informant asked that he has to load some materials then petitioner No.1 started to abuse and caused assault. Later on, in the evening, petitioners and Chhote Pandey reached boarding on four wheeler and motorcycle to the house of informant and started to cause assault to him.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant pre-arrest bail to the petitioners. Accordingly, their prayer for grant of pre-arrest bail stands rejected. The petitioners are directed to surrender before the trial Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
