====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-05-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.

It is alleged that petitioner committed theft of jewellery and some cash in the house of the informant. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has been made accused on the basis of confessional statement of co-accused namely, Mithun Kumar. No incriminating article has been recovered from the possession of the petitioner and there is no other material to show his complicity in the present case.

Considering the aforesaid facts and circumstances, let

Patna High Court CR. MISC. No.113 of 2023(2) dt.08-05-2023 2/2 the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Shikarpur P. S. Case No. 428 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
