JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Runni Saidpur P.S. Case No. 233 of 2017 registered for the offences punishable under Sections 341, 323, 307, 324, 326, 34 of the Indian Penal Code and Section 27 of the Arms Act.
As per FIR while informant was returning from his shop, petitioner and other accused persons surrounded him and there is allegation against the petitioner that he fired causing injury to the left arm of the informant.
Submission of learned counsel for the petitioner is that he was not present there, which will appear from location of mobile and injury is simple in nature and he has falsely been implicated.
Heard learned APP and learned counsel for the
Patna High Court CR. MISC. No.69397 of 2019(2) dt.05-11-2019 2/2 informant, who has opposed the prayer for anticipatory bail stating that injury report supports the prosecution case and informant received firearm injury and apart from that petitioner is accused in three other cases.
In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. Petitioner has to surrender and pray for regular bail. This application is, accordingly, dismissed.
