The petitioner seeks bail in Mehsi P.S. Case No. 257/2018, instituted for the offences under Sections 37(a)(b), 30 and 38 of Bihar Prohibition and Excise Act, 2016. It is alleged that 80 litres of toddy has been recovered from near village Bakhari Nazir Bazar ahead from Masjid in Lochiwani.
Learned counsel for the petitioner has submitted that one person, namely, Binod Sah was apprehended on the spot who disclosed the name of this petitioner. It is also alleged that smell of liquor was coming from the mouth of co-accused Binod Sah. Petitioner is in custody since 14.08.2018. He has clean antecedent.
Patna High Court Cr.Misc. No.64249 of 2018 (2) dt.26-10-2018 Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Motihari in connection with Mehsi P.S. Case No. 257/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
