The petitioners seek bail in Shambhuganj P.S. Case No. 106 of 2015 instituted for the offence under Sections 147, 148, 149, 307, 302 of the Indian Penal Code and Section 27 of the Arms Act.

Counsel for the petitioners submits that petitioners are named in the written report. There is no specific allegation of firing against them. They are named as members of unlawful assembly. The specific allegation of firing is against co-accused Sanjay Yadav and Shekhar Yadav. Counsel for the petitioners further submits that other co-accused persons with similar

Patna High Court Cr.Misc. No.64563 of 2018 (2) dt.31-10-2018 2/2 allegation have already been granted bail by coordinate Bench of this Court vide order dated 07.04.2016 passed in Cr. Misc. 14359 of 2016.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Banka, in connection with Shambhuganj P.S.
