The petitioner seeks regular bail in connection with Baluwa Bazar P.S. Case No. 30 of 2023 instituted for the offences punishable under Sections 356 and 379 of the Indian Penal Code. As per allegation in the FIR when the informant was returning from his Sasural, then four miscreants came from behind by two motorcycles and snatched his bag containing cash of Rs.27,500/- and also snatched one mobile phone. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that petitioner is neither named in the FIR nor put on
Patna High Court CR. MISC. No.79742 of 2023(2) dt.08-12-2023 2/2 test identification parade and he has been implicated in this case only on the basis of confessional statement of co-accused. Petitioner is in judicial custody since 14.06.2023. Learned APP for the State opposes the prayer for bail of the petitioner.
Considering the facts and circumstances of the case as well as the fact that petitioner is in judicial custody for about six months, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Supaul in connection with Baluwa Bazar P.S. Case No. 30 of 2023.
