JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-10-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier, the prayer for bail of the petitioner was twice rejected by this court taking into consideration that he opened fire causing death of the deceased.

Submission on behalf of the petitioner is that the petitioner is in jail custody for more than two years but up till now charge could not be framed against him.

Considering the aforesaid facts and circumstances as well as submission of the parties, again I am not inclined to release the petitioner on bail and, accordingly, his prayer for bail in connection with session trial no. 12 of 2018 arising out of Kusheshwar Asthan P.S.Case No. 167 of 2013 stands rejected However, the learned trial court is directed to

Patna High Court Cr.Misc. No.66531 of 2018 (2) dt.31-10-2018 2/2 expedite the trial of the petitioner and try to conclude the same as early as possible.
