====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 31-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Forest C.C. No. 35/2018, instituted for the offences under Sections 41 and 42 of Indian Forest Act.

It is alleged in the written report that on getting information that a truck containing Khair wood is standing at Fatehpur Chowk, the informant along with forest ranger and forest guard reached there. It is further alleged that owner of the truck was also coming along with truck loaded with Khair wood, but seeing the forest guard he fled away taking advantage of darkness. It is alleged that 4.5 cubic meter of Khair wood was recovered from aforesaid truck.

Patna High Court Cr.Misc. No.64636 of 2018 (2) dt.31-10-2018 2/2 Learned counsel for the petitioner has submitted that petitioner is driver of aforesaid truck. He has clean antecedent. Petitioner is in custody since 07.08.2018.

Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Forest C.C. No. 35/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
