Petitioner seeks bail in Garkha P.S. Case No.389 of 2018 instituted for the offence under Section(s) 420, 467, 468, 471/34 Indian Penal Code, Sections 30, 30(a), 38, 41 of the Bihar Prohibition & Excise Act, 2016.

Counsel for the petitioner submits that petitioner has clean antecedents. There is no recovery from his conscious possession. He was caught running away from the place of occurrence.

It is alleged that 1035 litres foreign liquor has been recovered from the pick up van and 2160 litres foreign liquor has been recovered from the truck while loading and unloading. Accordingly, seizure list was prepared.

Patna High Court Cr.Misc. No.64005 of 2018 (2) dt.12-10-2018 2/2 Petitioner is in custody since 10.09.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the 6th Additional Sessions Judge, Saran, in connection with Garkha P.S. Case No.389 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
