Petitioner seeks bail in Chiraiya P.S. Case No. 168/18 registered for the offence under Sections 399, 402, 414 of I.P.C. and Sections 25(1-b)a, 26, 35 of the Arms Act. Allegation is of recovery of one country made pistol and three live cartridges from possession of the petitioner. Submission on behalf of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case and he is in custody since 22.05.2018 having no criminal antecedent.

Heard the learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances of the case, stated above, let the petitioner, above

Patna High Court Cr.Misc. No.64872 of 2018 (2) dt.02-11-2018 2/2 named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of S.D.J.M., Sikrahana, at Dhaka, East Champaran, Chiraiya P.S.Case No.168 of 2018 with condition that bailers must be of local having sufficient immoveable properties within jurisdiction of the court concerned.
