JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-11-2019 This application, for grant of anticipatory bail, arises out of Jandaha P.S. Case No. 176 of 2019, disclosing offences under Sections 304 (B) /34 of the Indian Penal Code. Petitioner is named in the F.I.R. and the case is under Section 304(B) of the Indian Penal Code.

Submission of learned counsel for the petitioner is that she has no concern with the family of the husband of the deceased and she is co-villager and has falsely been implicated in this case.

Heard learned A.P.P. also as well as learned counsel for the informant. Learned counsel for the informant has opposed the prayer for anticipatory bail and submitted that proclamation against the petitioner has already been issued and same has been affixed on the house of the petitioner.

No.68890 of 2019(2) dt.18-11-2019 2/2 Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the petitioner to surrender in the court below within three weeks from the date of receipt of a copy of this order and the court below shall verify the above submission of informant that proclamation has been issued and if it is found true, the petitioner has to surrender and pray for regular bail, otherwise, the court below shall release the petitioner on bail to his own satisfaction.
