Petitioner, who is in custody, seeks bail in connection with G.R. No. 2682 of 2018 arising out of Dharahra P.S. Case No. 231 of 2018 registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code and under Section 8 of 2012 of the POCSO Act, 2012.
Informant who is the father of the victim girl has alleged that when his daughter had gone for tuition, petitioner along with other co-accused enticed and eloped with her daughter.
It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case on the basis of suspicion and dirty
Patna High Court Cr.Misc. No.65738 of 2018(2) dt.06-11-2018 2/2 politics. No specific allegation is made against the petitioner. There is general and omnibus allegation against petitioner. Petitioner is a student. He is disabled and was arrested on the same day as such allegation against him is not true. He has no criminal antecedent. He is in custody since 30.08.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Tribhubhan Nath, learned Additional Sessions Judge-I, Munger in connection with G.R. No. 2682 of 2018 arising out of Dharahra P.S. Case No. 231 of 2018.
