2. Petitioner seeks regular bail in connection with Bakharpur P. S. Case No. 40 of 2025 in a case registered for the offences punishable under Sections 103(1) and 238 read with Section 3(5) of the Bharatiya Nyaya Sanhita.

Prosecution case, in brief, is that on 13.06.2025 at about 10:00 A.M. the informant received an information that a dead body of a lady was floating in the Ganga river and the dead body was identified as the wife of Bhikhari Singh. On verification of the said occurrence, it is learnt by the informant that the petitioner and other co-accused persons had thrown the dead body in the Ganga river with an intention to hide the same and in the course of throwing the dead body, the co-accused Banti Singh also drowned in the river and died.

Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case merely on the basis of being an accomplice of the other co-accused person in disposal of the dead body. There is no allegation that this petitioner killed the deceased. From perusal of the FIR it is clear that it was the co-accused Bhikhari Singh who killed the deceased. Petitioner has clean criminal antecedent and he is in custody since 14.06.2025. Charge-sheet has already been submitted.
5. However, learned A.P.P. for the State vehemently opposed the bail application.

Considering the nature of accusation and period of custody, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Bhagalpur/concerned Court below in connection with Bakharpur P. S. Case No. 40 of 2025.
