JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-04-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 420/506 of the Indian Penal Code.

Prosecution case is that the petitioner got deposited Rs.1.50 lacs from the complainant on the assurance that he would get Rs.4 lacs on maturity of the Sahara Q Shop plan and when the complainant demanded his money, the same was not given by the petitioner.

Learned counsel for the petitioner submits that the petitioner is merely a manager of the bank and petitioner had made investment with the bank and not a single penny was credited to the account of the petitioner. He further submitted

No.2194 of 2023(2) dt.11-04-2023 2/2 that the deposits of the complainant was an advance under the plan which accrues loyalty bonus points (LBP) and the advance amount and LBP was to be utilized for purchasing goods or services only and no money was refundable. Petitioner has got no criminal antecedent.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Begusarai in Complaint Case No. 1641(c) of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
