JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-03-2023 The present writ petition has been filed seeking the following reliefs:- "1. (I)That the present writ application has been filed for issuance of an appropriate writ(s)/ order(s)/ direction(s) in the nature of Mandamus for a direction to the concerned respondent authorities to lodge an F.I.R. against the land mafias and anti-social elements who have assaulted the petitioner and have ransacked, demolished, destroyed the homestead property and

(II). That the present writ application has been filed for issuance of an appropriate writ(s)/ order(s)/ direction(s) in the nature of Mandamus for a direction to the concerned respondent authorities to provide adequate safety and security to the petitioner to protect and preserve his life and property;

(III). That the present writ application has been filed for issuance of an appropriate writ(s)/ order(s)/ direction(s) in the nature of Mandamus for a direction to the concerned respondent authorities to enforce the Order dated 24.09.2022 of the competent court by which the step-sisters of the petitioner and their vendees have been restrained from interfering with the peaceful possession of the homestead property of the petitioner;

(IV). That the present writ application has been filed for issuance of an appropriate writ(s)/ order(s)/ direction(s) in the nature of Mandamus for a direction to the concerned Court below to expedite the adjudication of the Probate Case No. 01/2022 in the facts and circumstances of the case and in the interest of justice."

Patna High Court CWJC No.754 of 2023(2) dt.22-03-2023 3/3 At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Superintendent of Police, Purnea for redressal of his aforesaid grievances.

Liberty so sought is granted.

It is needless to state that in case, the petitioner approaches the Superintendent of Police, Purnea by filing appropriate representation, annexing all the relevant documents in support thereof, within a period of four weeks from today, appropriate steps, in accordance with law, shall be taken, forthwith.

The writ petition stands disposed off on the aforesaid terms.
