JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-12-2018 Petitioners pray for bail in connection with Balthar P.S. Case No. 85 of 2018 registered for the offence punishable under Section 30A of Bihar Prohibition and Excise Act. Allegation against the petitioners is of recovery of 135 litres of liquor from the dicky of vehicle and petitioners were arrested there.

Submission of learned counsel for the petitioners is that they have no criminal antecedent and they have falsely been implicated in this case which will appear from the fact that their signatures were not obtained in the seizure list and they are in custody since 21.7.2018.

Having heard both sides and in the facts and

No.69113 of 2018(2) dt.03-12-2018 2/2 circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, West Champaran, Bettiah, in connection with Balthar P.S.Case No. 85 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
