JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-11-2019 Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the State. The petitioner seeks Regular Bail in connection with Powakhali P. S. Case No. 35 of 2017, registered for the offences punishable under Sections 379, 120(B) and 420 of the Indian Penal Code.

The allegation is regarding the petitioner being the driver of a truck carrying raw tobacco. However, the raw tobacco is said to have been stolen from the said truck and the petitioner has been implicated in the present case on account of suspicion being raised by the owner of the raw tobacco. The learned counsel for the petitioner has submitted that the petitioner has got no complicity in the mater and in fact,

No.75191 of 2019(3) dt.25-11-2019 2/2 he had parked the truck on the side of the road and was taking rest nearby, however, when he came back in the morning, he found that the tobacco had been stolen. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 02.09.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on Regular Bail.

Accordingly, the above named petitioner is directed to be enlarged on Regular Bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Powakhali P. S. Case No. 35 of 2017.
