Petitioners seek bail in Sheosagar P.S. Case No. 161 of 2014 registered for the offence punishable under Sections 341, 323, 379/34 of the IPC and later on Section 302 of the IPC has also been added.
Allegation against the petitioners is of assaulting the mother of the informant with fists and slaps and snatching her money and hasuli. Petitioner no. 1 is order giver. It has been submitted on behalf of the petitioners that they are innocent and have been falsely implicated in this case.
Patna High Court Cr.Misc. No.64983 of 2018 (3) dt.20-11-2018 2/2 Petitioners are co-villagers of the informant. The occurrence took place on 21.07.2018 whereas the mother of the informant died on 01.08.2014 due to chronic disease. . Petitioners have got no criminal antecedent and they are in custody since 25.07.2018. Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, Rohtas, in connection with Sheosagar P.S. Case No. 161 of 2014 with following conditions:-
(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioners shall co-operative in the trial and shall be properly represented on each and every date fixed by the Court and shall remain personally present whenever directed by trial court and his absence on two consecutive dates the trial court shall be at liberty to cancel their bail bond.
(3) If the petitioners tamper with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners. (S. Kumar, J) sushma/- U T
