The petitioner seeks regular bail in connection with Deep Nagar P.S.Case No.218 of 2019, G.r.No.4247 of 2019 registered for offences punishable under Sections 30(A) ©, 32(B), 33 and 36 of the Bihar Prohibition and Excise Act, 2016. There is recovery of 525 ltrs. of spirit from a Tata 407 vehicle.

Submission of the learned counsel for the petitioner is that he was not arrested at the spot rather he has been made accused only on suspicion and he is in custody for four months. Charge sheet has been submitted .

Heard learned A.P.P. who has opposed the prayer for bail on the ground that there is recovery of huge quantity of liquor.

Patna High Court CR. MISC. No.70144 of 2019(2) dt.11-12-2019 2/2 He is accused in four other cases and three of the cases are under the same offence.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner at this stage however, once the charge is framed in this case the petitioner is at liberty to move for grant of bail.
