Petitioner seeks bail in Phulparas P.S. Case No.71 of 2018 instituted for the offence under Section(s) Section 30 (a), (d), 32(2), 36, 38(i) of the Bihar Prohibition & Excise Act, 2016. Counsel for the petitioner submits that there is no recovery of any illicit liquor from possession of the petitioner. The police has arrested this petitioner in connection with Phulparas P.S. Case No.168 of 2018 and on the basis of confessional statement of the petitioner before the police petitioner has been arrested in this case.

Petitioner is in custody since 08.08.2018.

In the facts and circumstances of the case, prayer of

Patna High Court Cr.Misc. No.66203 of 2018 (2) dt.05-11-2018 2/2 the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the ADJ II, Excise Act, Madhubani, in connection with Phulparas P.S. Case No.71 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
