2. The petitioners apprehend their arrest in connection with Motipur P.S. Case No. 188 of 2021, registered for the offences punishable under Sections 302, 120(B) and 34 of the Indian Penal Code.
3. As per the allegation, the son of the informant went for a feast to the house of Narsingh Sahani, wherefrom the petitioners and other co-accused persons took him, and thereafter his dead body was recovered.
4. The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated. He has submitted that during the investigation it has

No.78061 of 2023(4) dt.14-10-2025 2/2 come in the statements of the witnesses that co-accused Meghnath Sahani had entered into the house of one Gagan Deo, which was seen by the deceased; thereafter, Meghnath Sahani was apprehended and was assaulted by the villagers. He submitted further that the motive is only against Meghnath Sahani and not these petitioners. Petitioners claim clean antecedent.

On the other hand, the learned APP for the State has opposed the prayer for bail and submitted that the witnesses who saw the accused persons accompanying the deceased, along with the main accused, Meghnath Sahani, have had their statements recorded by the investigating authorities, from which it appears that the petitioners and Meghnath Sahani had committed murder of the deceased. Learned APP has also submitted that as many as nine injuries have been found on the person of the deceased, and the investigation is still continuing.
6. Considering the above-mentioned facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner. Accordingly, it is rejected. (Nawneet Kumar Pandey, J) AjayMishra/- U T
