This application for bail arises out of Barachatti P.S. Case No. 349/2018 for the offences under Sections 18, 20 and 22 of the N.D.P.S. Act.
Learned senior counsel appearing on behalf of the petitioners submitted that the petitioners did not have any direct participation in commission of the offence and as a matter of fact they were simply Driver and Cleaner of the truck from where the contraband articles came to be recovered by the prosecution.
I am not inclined to grant regular bail at this stage in view of the nature of the offence alleged and the bar under
Patna High Court Cr.Misc. No.65999 of 2018(2) dt.03-12-2018 2/2 Section 37 of the N.D.P.S. Act.
This application is accordingly rejected.
