JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-07-2020 Heard Ms. Mayuri, learned counsel for the petitioner, Mr. Parmeshwar Mehta, learned A.P.P. for the State, and Mr. Siddharth Harsh, learned counsel for the State Food Corporation, through Video Conferencing.

The petitioner apprehends his arrest in connection with Kargahar Police Station Case No.174 of 2013 registered under Sections 420, 409, 467, 468 and 120-B of the Indian Penal Code. The accusation is that in the year 2012-13, Tribhuvan Ram, the Block Welfare Officer, Sheosagar, deputed as Incharge Purchase Centre, Kargahar, in collusion with Gautam Kumar Singh, Subject Matter Specialist, and Sharda Kumar Singh, Kisan Salahkar, misappropriated the paddy weighing 1421.84 Metric Tonnes, causing loss to the State Exchequer.

No.82151 of 2019(5) dt.02-07-2020 2/2 Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and he has no concern in any manner either to Purchase Centre or to any Rice Mill. Only in the Supervision Note of the Dy. S.P., as detailed in paragraph-69 of the case diary, without any basis, the name of the petitioner and others surfaced having indulged in misappropriation of the alleged paddy. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Kargahar Police Station Case No.174 of 2013, subject to the conditions laid down under Section 438(2) Cr.P.C.
