JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 17-12-2018 Heard learned counsel for the petitioner, learned for the State being assisted by the learned counsel for the informant. The petitioner seeks pre-arrest bail in connection with Pawana P.S. Case No.41 of 2016 registered under Sections 147, 148, 149, 342 and 302 of the Indian Penal Code and 27 of the Arm Act.

Considering that on completion of investigation though the police submitted charge-sheet against some of the named accused persons, but the petitioner was not sent up for trial and differing with the police report the learned Magistrate took cognizance of the offence on 13.06.2018 without assigning any reason, in the event of arrest or surrender before the court below within six weeks from today, the petitioner is directed to

Patna High Court Cr.Misc. No.67170 of 2018(2) dt.17-12-2018 2/2 be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bhojpur at Ara in connection with Pawana P.S. Case No.41 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
