This is the second attempt on behalf of the petitioner for grant of bail in connection with Sessions Trial No.44 of 2025, arising out of Tedhagachh P.S. Case No.131 of 2024 registered for the offence under sections 80, 85, 103(1) and 3/5 of the B.N.S., 2023.

Earlier, the prayer of the petitioner for grant of bail was allowed by this Court vide order dated 07.05.2025 passed in Criminal Miscellaneous No.28381 of 2025 as it was submitted on behalf of the petitioner that the child is staying with the family of the petitioner but subsequently, at the time of furnishing the bail bonds, it has come that the child was staying with his maternal aunt (Mausi) and therefore, the bail bonds of the petitioner was not accepted by the court below.

Learned counsel for the petitioner submits that though the petitioner is in custody since 10.11.2024 but the trial is not proceeding.

Considering the earlier order of this Court by which the petitioner was granted bail, the period of custody of the petitioner and the delay in trial, this bail application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Kishanganj / concerned Court below, in connection with Tedhagachh P.S. Case No.131 of 2024, subject to the condition that he will cooperate in the trial and will appear himself or through his lawyer of each and every date fixed in the trial.
