JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-11-2019 This application, for grant of anticipatory bail, arises out of Ekama P.S. Case No. 68/2019, disclosing offences under Sections 447, 448, 341, 323, 324, 307, 504 and 34 of the Indian Penal Code.
Allegation against the petitioner and others is of assault to the husband of the informant and specific allegation against this petitioner that he inflicted farsa blow on the head of husband of the informant.
Submission of learned counsel for the petitioner is that there is case and counter case between the parties and he has instruction that no injury report is available on record. Learned counsel for the State opposed the prayer for anticipatory bail and submitted that the informant was got treated in the primary health center after assault.

No.71039 of 2019(2) dt.07-11-2019 2/2 Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the petitioner to surrender in the court below within a period of three weeks' from the date of receipt of a copy of this order, on which, the court below shall release him on provisional bail to his own satisfaction and in the meantime, call for the injury report and verify the same and if the submission of learned counsel for the petitioner that there is no injury report, is found true or injury sustained by the informant is found simple in nature, the court below shall confirm the provisional bail of the petitioner, otherwise, the court below shall pass the order as he deems fit and proper including cancellation of provisional bail of the petitioner.
