The petitioner seeks regular bail in connection with Mojahidpur (Babarganj) P.S. Case No. 117 of 2018 for the offence registered under Section 395 of the Indian Penal Code. The allegation is regarding the accused persons including the petitioner herein having intercepted the informant whereafter they are said to have snatched a sum of Rs. 40,000/- from the informant. The name of the petitioner is said to have transpired when the accused persons were calling each other by their names.

The learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in the present case and is languishing in custody since 10.06.2018.

No.69717 of 2019(2) dt.10-01-2020 2/2 The learned counsel for the petitioner has further submitted that the aforesaid amount of cash looted from the informant has not been recovered from the petitioner and in fact the materials on record would bear it out that the petitioner has got no complicity in the alleged occurrence.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner coupled with the fact that the petitioner is languishing in custody since 10.06.2018, I deem it fit and proper to direct for release of the petitioner herein on regular bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions JudgeIX, Bhagalpur in connection with Mojahidpur (Babarganj) P.S. Case No. 117 of 2018.
