2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 420/409 of the Indian Penal Code.

3. As per the prosecution case, petitioner did not complete the work for which he withdrew Rs.7,49,885/-.

4. Learned counsel appearing for the petitioner refers to the counter affidavit filed on behalf of Municipal Commissioner, Muzaffarpur, wherein in paragraph 6 it has been stated that the work has been completed. Petitioner claims clean antecedent.

5. Learned counsel for opposite party no.2 does not controvert the aforesaid fact.

6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing
