Petitioners are apprehending their arrest in connection with Raghunathpur P.S.Cae No.145 of 2019 , registered for offences punishable under Sections 302,354(B), 34 of the Indian Penal Code.
As per FIR, it apperas that there was dispute with respect to payment of and the deceased came and settled the dispute. It is further alleged that in the next morning the accused persons ten in number came variously armed and assaulted her husband causing his death at the spot.
Submission of the learned counsel for the petitioners is that no specific allegation has been attributed against them
Patna High Court CR. MISC. No.75946 of 2019(3) dt.16-12-2019 2/2 and there is one injury on the person of the deceased. It is further submitted that they have no concern with the shopkeeper of the Cigerates shop where the occurrence took place and all the Manjhi have been implicated in this case. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the learned court below within a period of three weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM VIII, Siwan in connection with Raghunathpur P.S.Case No.145 of 2019 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to cooperate in the investigation and appear as and when required.
