JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2018 The petitioner seeks regular bail in connection with Dehri (Town) P.S. Case No. 398/2016 corresponding to Sessions Trial No. 548/2016, registered for offences punishable under Section 302 and 34 of the Indian Penal Code.

Allegation against petitioner and other accused persons is of mounting on the chest of deceased and causing injury to him due to which he died.

Submission of learned counsel for the petitioner is that the post-mortem report does not show any external or internal injury on the person of deceased and on that ground coaccused on similar allegation has been granted bail vide order dated 08.03.2018 passed in Cr. Misc. 12062/2018 and the petitioner is in custody since 18.06.2018.

Heard learned A.P.P. also.

No.65421 of 2018(2) dt.20-11-2018 2/2 Having heard both sides, considering the facts and circumstances of the case, let the petitioner above-named, be released on bail on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge 4th, Rohtas at Sasaram in connection with Dehri (Town) P.S. Case No. 398/2016 corresponding to Sessions Trial No. 548/2016, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
