JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-11-2019 Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor for the State. This is an application for grant of Anticipatory Bail in connection with Bakhtiyarpur (Kaneria O.P.) P. S. Case No. 262 of 2019, registered for the offences punishable under Sections 341, 323, 324, 308, 504/34 of the Indian Penal Code. The allegation is regarding the accused persons having abused and assaulted the informant resulting in injury on her finger.

The learned counsel for the petitioners has submitted that petitioners have been falsely implicated on account of previous land dispute existing in between the parties and the fact

Patna High Court CR. MISC. No.76137 of 2019(2) dt.25-11-2019 2/2 is that the petitioners have also filed a complaint case. Lastly, it has been submitted that the petitioners are female and having a clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on Anticipatory Bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of leaned Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur (Kaneria O.P.) P. S. Case No. 262 of 2019, subject to the conditions as laid down under Section 438(2) of the CrPC.
