JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22.11.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under section 302/34 of the IPC.

The petitioner is in jail custody since 18.6.2018 on the accusation that he along with others sat on the chest of the deceased as a result of which he died then and there. However, learned counsel for the petitioner drew my attention towards order dated 8.3.2018 passed in Cr. Misc. no. 12062/2018 by a coordinate bench of this court and submitted that coordinate bench of this court while considering bail prayer of co-accused Ravi Kumar noticed

Patna High Court Cr.Misc. No.66031 of 2018 (2) dt.22-11-2018 that no external or internal injury was found on the person of the deceased and taking note of the aforesaid fact, coordinate bench of this court granted bail to co-accused Ravi Kumar.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge IV, Rohtas at Sasaram in Sessions trial no. 548/2016 arising out of Dehri (Town) P.S. Case no. 398/2016.
