Petitioner, who is in custody, seeks bail in connection with Kursakanta P.S. Case No. 128 of 2015 registered for the offences punishable under Sections 364, 302, 201 & 120(B)/34 of the Indian Penal Code.

Allegation against the petitioner and other accused persons is of kidnapping and killing husband (deceased) of the informant when he was sleeping.

It has been submitted that petitioner is innocent and has committed no offence. Petitioner is not named in the F.I.R., the name of the petitioner has transpired on the statement of Harilal Sah. Similarly placed co-accused have been granted bail by co-ordinate Bench of the Court in Cr. Misc. No. 6294 of

Patna High Court Cr.Misc. No.64989 of 2018(2) dt.05-11-2018 2/2 2016, Cr. Misc. No. 4028 of 2016 and Cr. Misc. 11516 of 2016 vide order dated 02.03.2016, 24.02.2016 and 28.04.2016 respectively.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Araria, in connection with Kursakanta P.S. Case No. 128 of 2015 (S. Kumar, J) Rajiv/- U T
