Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 272, 273 of the IPC and Sec. 30(a) of the Bihar Prohibition and Excise Act, 2016.

Huge quantity Indian made foreign liquor were recovered from newly constructed primary school, which was situated near the house of the petitioner and accordingly, the petitioner has been made accused in this case. Moreover, para-3 of the petition goes to show that prior to institution of the present

Patna High Court Cr.Misc. No.66530 of 2018 (2) dt.22-11-2018 2/2 case, only one case had been registered against the petitioner. Considering the facts and circumstances as well as submission of the parties, let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge II-cumSpecial Judge, Excise, Madhubani in Rahika P.S. Case No. 150 of 2017, G.R. No. 875 of 2017.
