JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2018 The petitioner seeks regular bail in connection with Nabinagar P.S. Case No. 190 of 2010, registered for offences punishable under Sections 147, 148, 149, 447, 323, 307, 425 and 427 as well as 436 of the Indian Penal Code and Section 17 of C.L.A. Act.

Allegation as per F.I.R. is that a group of 60-70 extremists came and started assaulting the informant, who is the guard supervisor of NTPC. They also set fire Haiwa vehicle, solar, generator etc.

It has been submitted on behalf of the petitioner that petitioner is not named in the F.I.R., his name surfaced in the case on the confession of the co-accused and except that there

Patna High Court Cr.Misc. No.66773 of 2018(2) dt.26-11-2018 2/2 is nothing against the petitioner and the F.I.R itself shows that large number of persons had come and assaulted the informant. Further petitioner has been in judicial custody since 03.07.2018 and other co-accused having similar allegation has already been enlarged on bail by a coordinate Bench of this Court vide order dated 24.01.2017 passed in Cr. Misc. No. 40905 of 2016.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Nabinagar P.S. Case No. 190 of 2010, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
