JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 The petitioner seeks regular bail in connection with Buxar (Muffasil) P.S. Case No. 175 of 2019, registered for offences punishable under Section 392 of the Indian Penal Code. Allegation as per F.I.R. is that while the informant was coming after collecting Rs. 1.50 lac, some miscreants came and snatched away his bag containing the cash of Rs. 1.50 lac. Petitioner is not named in the F.I.R., his name transpired on confession of co-accused and apart from that he is accused in five other cases.

It has been submitted on behalf of the petitioner that save and except the confessional statement of co-accused, there is absolutely nothing against the petitioner and nothing has been recovered from his possession and he has been in judicial custody for last six months and ready to abide by any condition imposed

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Buxar (Muffasil) P.S. Case No. 175 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds with further subject to the condition that petitioner after his release, has to appear before the Officer-in-Charge of the police station of his area in the first week of each month for a period of nine months or till disposal of trial, whichever is earlier, so that the police may watch his conduct during that period.

Let a copy of this order be communicated to the Superintendent of Police, Buxar for needful.
