JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2018 Earlier prayer for bail of the appellant was rejected by this Court vide order dated 19.5.2017 passed in Cr.Appeal (SJ).No. 101 of 2017 with direction to learned trial court to conclude the trial within a period of nine months and appellant was given liberty to renew his prayer for bail if trial is not concluded within the said period.

Submission of learned counsel for the appellant is that nine months period has already expired and till date trial has not been concluded. Further submission is that all the prosecution witnesses have been examined in this case and appellant is in custody since 20.10.2016.

Heard learned Special P.P., who has opposed the prayer for bail.

Patna High Court CR. APP (SJ) No.856 of 2018 (4) dt.11-04-2018 2/2 Having heard both sides and in view of the above facts and circumstances, I am not inclined to grant bail to the appellant. However, as according to the appellant the prosecution witnesses have been examined, learned trial court is directed to expedite the trial by conducting it on day-to-day basis so that the trial may be concluded within two months.
