Petitioner seeks regular bail in connection with Konch P.S. Case No.251 of 2018 for the offence punishable under Sections 147, 148, 149, 341, 324, 326, 323, 504, 307 and 302 of the Indian Penal Code.

The allegation against the petitioner is that the petitioner along with other accused person assaulted the husband of the informant, leading to his death. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and there is no specific allegation against the petitioner of assault and the allegation at best upon the petitioner and others is general and omnibus in nature. Learned counsel referring to Annexure-2

Patna High Court CR. MISC. No.69156 of 2019(2) dt.04-12-2019 2/2 submits that similarly situated accused person, Pramod Yadav, has been granted bail by this Court in Cr. Misc. No.60233 of 2019.

Having regard to the submissions made by the parties and taking into consideration the fact that the allegation against the petitioner is general and omnibus and similarly situated accused has been granted bail by this Court, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-3rd, Gaya, in connection with Konch P.S.
