The petitioner seeks regular bail in connection with Brhampur (Chakki O.P.) P.S.case no.353 of 2019 registered for offences punishable under Sections 25(1-b)a,26 and 35 of the Arms Act.

There is recovery of one country-made pistol and cartridges from beneath the chowki, on which the petitioner along with other accused persons were sleeping. Submission of the learned counsel for the petitioner is that nothing has been recovered from his possession. House is a joint house and he is in custody since 7.8.2019. Charge sheet has already been submitted. There is no chance of tampering with the evidence.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Buxar in connection with Brhampur (Chakki O.P.) P.S.case No.353 of 2019. With the above direction, this application is allowed.
