2. The petitioner seeks bail in connection with Nabinagar P.S. Case No. 298 of 2023 registered for the offence punishable under Sections 364 and 302/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and other criminals are said to have assaulted the victim and killed him.

4. The post-mortem report shows multiple injuries on the deceased. The petitioner is in jail since 04.09.2023.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the fact that the role of the petitioner has come during investigation, I am not inclined to grant bail to

Patna High Court CR. MISC. No.80928 of 2023(3) dt.05-03-2024 2/2 the petitioner.

7. Accordingly, this application stands dismissed.
