JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-12-2018 Petitioner prays for bail in connection with Barauni P.S. Case No. 258 of 2018 registered for the offences punishable under Sections 461, 380 and 411 of the Indian Penal Code. Allegation as per FIR is of commission of theft of mobile and other articles from the shop of the informant and petitioner is not named in the FIR and later on co-accused has been arrested, who disclosed the name of this petitioner and petitioner was arrested with stolen mobile.

Submission of learned counsel for the petitioner is that confessional statement of co-accused shows that petitioner has purchased the mobile from the co-accused and apart from that there is nothing against him and he is in custody since 2.8.2018, having no criminal antecedent.

No.69126 of 2018(2) dt.03-12-2018 2/2 Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Barauni P.S.Case No. 258 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
