Ms.Sharda Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-01-2020 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek regular bail in connection with Gopalpur P.S. Case No. 178 of 2019 for the offence registered under Sections 272, 273 and 420 of the Indian Penal Code and Sections 30(a), 35 and 38 of the Bihar Prohibition and Excise (Amendment) Act, 2018.

The allegation is regarding recovery of 37.60 litres of illicit liquor from a sack being carried by the petitioners while they were coming from U.P. and were intercepted by the police and search was made.

The learned counsel for the petitioners has submitted

Patna High Court CR. MISC. No.69735 of 2019(2) dt.10-01-2020 2/2 that the petitioners are innocent and they have been falsely implicated in the present case. It is further submitted that the petitioners are languishing in custody since 23.09.2019. Having regard to the facts and circumstances of the case and considering the submissions advanced by the learned counsel for the petitioners, I deem it fit and proper to direct the petitioners herein to be released on bail.

Accordingly, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J.-II, Gopalganj in connection with Gopalpur P.S.
