JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Buxar (Muffasil) P.S. Case No. 360 of 2018, registered for the offences punishable under Section 392 of the Indian Penal Code.

As per F.I.R. some miscreants entered inside the bank and lootted Rs. 1,45,000/- ( rupees One lakh forty five thousand) from the bank counter.

Submission of the learned counsel for the petitioner is that petitioner is not named in the F.I.R. later on, confessional statement of co-accused he has named in this case. Learned counsel for the petitioner further submits that nothing against the petitioner except confessional statement of co-accused. On the other hand, learned counsel for the petitioner

Patna High Court CR. MISC. No.71442 of 2019(2) dt.08-11-2019 2/2 has opposed the prayer of bail on the ground that in such type of case for the purpose of identification custodial interrogation is required. Moreover, petitioner is an accused in another case. Having heard both sides, in view of the allegation as discussed above, I am not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, this application is dismissed.
