The petitioner seeks regular bail in connection with Official Complaint Case No. 39 of 2023 instituted for the offences punishable under Sections 9, 11, 12, 39, 40, 40(A), 41, 42, 42(A), 43, 44, 48, 48(A), 50, 51, 58( C) and 58(i) of the Wild Life Protection Act, 1972 (Amended Act, 2022), however, cognizance has been taken for the offence under Section 51 of the Wild Life Protection Act, 1972 (Amended Act, 2022). As per the prosecution case, the informant conducted raid at the herbal shop of co-accused and recovered several organs of wild life animals and petitioner and other accused persons arrested at the spot. He further submits that similarly situated co-accused has already been granted regular bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 76958 of 2023 vide order dated 06.12.2023. Petitioner has got clean antecedent and he is in custody since 15.09.2023. Learned APP for the State opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of the case and also the fact that similarly situated co-accused has already been granted regular bail by a Co-ordinate Bench of this Court, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Raxaul at Motihari in connection with Trial NO.3751 of 2023 arising out of Official Complaint Case No. 39 of 2023 with condition that the petitioner shall appear before the court below on each and every date.
