The petitioner seeks pre-arrest bail in connection with Sanhaulla P.S. Case No.113 of 2018 registered for the offences punishable under Sections 376 and 120B read with 34 of the Indian Penal Code.
Regard being had to the statement of the victim recorded under Section 164 of the Code of Criminal Procedure as contained in Annexure-2 to the present case in which she has categorically stated that she is aged about 21 years and was in love with the petitioner for the last three years and had established physical relationship with him out of her own consent and when the petitioner refused to marry and demanded Rs.10 lakhs, the case has been instituted, in the event of arrest or
Patna High Court Cr.Misc. No.66430 of 2018(2) dt.14-12-2018 2/2 surrender in the court below within a period of six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Sanhaulla P.S. Case No.113 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
