JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2018 The petitioner seeks regular bail in connection with Mairwa P.S. Case No. 336 of 2018, registered for offences punishable under Sections 341, 323, 354, 506, 506 and 34 of the Indian Penal Code.
Allegation against the petitioner and other accused persons is that on 31.08.2018, when the informant was going for tuition classes, petitioner along wither other accused persons started teasing her and on protest being made by her, they pushed her and also threatened her.
It has been submitted on behalf of the petitioner that although petitioner is named in the F.I.R. but no allegation of any overt act has been attributed to the petitioner and he was only present there. Further petitioner has no criminal
Patna High Court Cr.Misc. No.66816 of 2018(2) dt.26-11-2018 2/2 antecedent and he has been in judicial custody since 03.09.2018.
Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -VII, Siwan, in connection with Mairwa P.S. Case No. 336 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
