The petitioner seeks regular bail in connection with Dholbajja (Kadwa) P.S.Case No.57 of 2019 registered for offences punishable under Section 414 of the Indian Penal Code.

As per FIR, allegation against the petitioner is that he was changing number plate of a motorcycle and on information the police reached there and on chase petitioner was arrested. It further appears that the motorcycle was later on recovered from the house of the co-accused.

Submission of the learned counsel for the petitioner is that co-accused from whose house the motorcycle was recovered has already been granted bail by the learned lower

Patna High Court CR. MISC. No.71888 of 2019(2) dt.11-12-2019 2/2 court itself, which will appear from Annexure -2. Petitioner is in custody for more than five months. Charge sheet has been submitted and he has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned D.K. Yadav, J.M. Ist Class, Naugachia in connection with Dholbajja P.S.Case No.57 of 2019.

With the above direction, this application is allowed.
