JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 10-04-2023 Heard learned counsel for the petitioner, learned law officer vigilance and learned APP for the State. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 467, 468, 471, 420, 120B of the Indian Penal Code. Prosecution story in nutshell is that informant was deputed for verification of the certificates of newly appointed Panchayat teachers of districts West Champaran and East Champran. Matriculation certificate of the petitioner was verified and as per letter of Examination

Patna High Court CR. MISC. No.6034 of 2023(2) dt.10-04-2023 2/3 Controller of Bihar Sanskrit Siksha Board Patna, his certificate found forged. Earlier a chance was given to such teachers to resign their job but this petitioner did not resign and after that this case has been lodged.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Neither the petitioner has committed any cheating nor he has used any forged document. It is pointed out that, vide order contained in letter No. 3449 dated 17.11.2022 passed by the District Program Officer, the employment of the petitioner has been ordered to be terminated and his salary has been ordered to be stopped. It is further submitted that the petitioner is languishing in judicial custody since 24.09.2022. Learned law officer vigilance has vehemently opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Semara (Chiutaha) P.S. Case No. 126 of

Patna High Court CR. MISC. No.6034 of 2023(2) dt.10-04-2023 3/3 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M., Ist, Bagha West Champran.
